As always, the local property market is not uniform. Byron Bay is probably overcooked and is slowing just like Sydney. Towns like Brunswick, Bangalow and Mullumbimby are still hot and there are multiple buyers for good listings. Most of the listings in Byron Bay town or main beaches are mainly top end, luxury properties.
The so-called Golden Grid in Byron Bay has been going gangbusters for the last year. 59 Carlyle Street is a renovated luxury 6 bedroom B&B. It just sold for $4.5M to a cash buyer from overseas who saw it online and did not inspect. Just down the road at 53 Carlyle is a property that is a newly renovated home is asking close to $4M. Good properties in good locations are attaining stratospheric heights.
The E Zone Story
Over 3000 properties in Byron Shire are affected by Ezones and/or Deferred Matter. What is this? Rural properties with Environmental Zoning (Ezone) or Deferred matter (DM) will have till December 8 to contact council and begin a negotiation on whether the Ezone designation should remain or be replaced by a more standard rural residential zoning.
The history of this is that all NSW shires must now be uniform in their zonings and Byron Shire’s LEP (Land and Environment Plan) needs to comply with statewide zonings. The Environmental Zonings are an extra complication as rural councils have done aerial mapping and designated bush land with an Ezone protection. Unfortunately, a lot of the mapping was either incorrect or included camphor laurel, lantana and other invasive weeds.
There is a good and bad story here, as usual. Although Council are keen to resolve the faulty mapping and work with landowners to make Ezones work, it has been a complete mess and will be costing rate payers many hundreds of thousands of dollars to clear up. Council, in their wisdom, did not follow state planning procedure and went their own way.
The good side of the coin is that council do not want to impede or constrain legitimate residential housing or farming. Also the staff dealing with the issue have been encouraged as most affected landowners sincerely want to retain wildlife habitat and high value vegetation. If you have received a letter form council alerting you to a DM or Ezone designation, don’t be deterred but join the process and lets make more homes for our furry animal residents and bird life as well as people. Since its costing us in the long run we may as well make it work.
Who Gives a Torrens?
This month BPS salutes Sir Robert Torrens who is credited with designing and implementing the Torrens Title system of land registration. Anyone who has had any dealings with land title systems in Asia or other countries will understand what a benefit this has been.
Established in South Australia in 1858, it was adopted throughout Australia and New Zealand, and subsequently spread across the world. Under the system, a Certificate of Title exists for every separate piece of land and details ownership, easements and/or rights of way affecting the land as well as any encumbrances including mortgages, leases and other interests in the land.
Unwanted Pizza Delivery
Sometimes it’s not great to have your property included in a film or TV production. The legions of fans of “Breaking Bad” are causing distress for a homeowner in Albuquerque, New Mexico. Breaking Bad was a very popular Netfix TV series about a high school science teacher with a popular recipe for Methamphetamine.
In one scene, the main character played by Brian Cranston, tries to reconcile with his estranged wife by bringing her a pizza. After being rebuffed he hurls the pizza onto the suburban roof and walks off in a huff. It has become a popular pastime for fans of the show to replicate the pizza-throwing scene and have the obligatory “selfie” taken. The current owners of the house have been forced to erect a two-metre high fence to try to dis-encourage the unwanted pizza deliveries. (Sourced From EPS Property Services)
DEFT Play at Auctions
Anyone attending an auction as a bidder needs to go prepared with a 10% deposit. This can be annoying as you either have to come with a bank cheque or make a transfer into the agent’s trust account prior to the auction. For large sums this can be a major inconvenience. Macquarie Bank have now developed a system which can bypass all of the hurdles. It is simply a matter of contacting Macquarie prior to the auction and providing them with your banking information. They will notify the relevant agent with your new DEFT (Digital Electronic Funds Transfer) reference number which will work for you if you are the winning bidder. Turning Our Sewerage into Gold
Mayor Simon Richardson, other councillors and staff currently have big dreams for a large piece of council owned land. Valances Road is to the North of Mullumbimby, off Coolamon Scenic Drive. The new Sewerage Treatment Plant (STP) is there but it is over 100 hectares and big enough to house big dreams.
The plan is to create a a state of the art centre for everything sustainable, recycling and renewable energy. It will include a major solar farm, bio char, green waste recycling plus a convention and education centre with visitor accommodation. There will be no cars allowed with an outside car park with people transported on electric buses and buggies. Yes I hear you scoff. Where is all the money coming from? Well, it may be that there are big-hearted, big-pocketed, new local residents who are prepared to put their money where the mouths are. Stay tuned and watch this space.
